Alert: California’s cannabis department proposes comprehensive regulatory changes

The Department of Cannabis Control (DCC) today released a comprehensive regulatory proposal to make changes to streamline and simplify the cannabis regulations, enhance consumer protections and make permanent changes that are currently in effect as emergency regulations. The proposal is a continuation of efforts by the Administration and DCC to refine and strengthen the cannabis regulatory framework.

The proposed regulations include:

  • Changes that are in effect as emergency regulations from the fall

  • Additional changes to streamline and strengthen the regulatory framework

Today’s release is the first step in the regular rulemaking process and begins a 45-day public comment period. It is anticipated that the proposed regulations will become effective in fall 2022, if approved.

Notice of proposed rulemaking to adopt consolidated medicinal and adult-use cannabis regulations

DCC is providing notice to the public of a proposed regulatory action to adopt consolidated Medicinal and Adult-Use Commercial Cannabis Activity regulations. The purpose of these regulations is to make permanent the emergency regulations DCC adopted on September 27, 2021, following the consolidation of the three original cannabis licensing authorities into the new DCC. The proposed regulations would also make additional regulatory changes.

How to submit a public comment

Any interested person or their representative can submit comments relevant to the proposed regulatory action. All comments must be received by April 19, 2022, at 5 p.m. A public comment template is included our website for your convenience.
